Dostałem fakturę na kwotę wyższą niż zasiłek lub górnej granicy, ale nie otrzymałem komunikatu ostrzegawczego. Czy to normalne?

Możliwe jest również, że otrzymałeś wysoki rachunek w związku z korzystaniem z usług Premium lub wiadomości tekstowych.

Jednak, jeśli uważasz, że coś jest nie tak, możesz Rzecznika Praw Obywatelskich.

I declare that I have read and understood the following provisions:

1) In accordance with Article 43 bis §3, 7 of the Act of 21/03/1991 on the reform of certain economic public companies, the Office of the Ombudsman for Telecommunications is tasked with: “examining a request from any person who claims to be the victim of a malicious use of an electronic communications network or service for information about the identity and address of the users of the electronic communications networks or services who have bothered this person, provided that this information is available.

The Office of the Ombudsman for Telecommunications grants the request if the following conditions are met :
a)the facts appear to have been established;
b)the request relates to specific dates and times.”

2) The Office of the Ombudsman for Telecommunications asks the relevant operator to provide him with the list of incoming telephone calls.

The Office of the Ombudsman for Telecommunications strictly limits itself to examining these telephone details and cannot be held liable if the information provided to it is incomplete or incorrect.

The Office of the Ombudsman for Telecommunications is under no circumstances authorised to contact the holder of the connection from which the malicious calls/SMS’s originated nor to act as conciliator.

3) The identity and address communicated by the Office of the Ombudsman for Telecommunications relate to the HOLDER of the calling number.

It is therefore not certain that this person is actually the perpetrator of those calls, as the line may have been used by third parties.

4) Not all calls/SMS’s can be identified. Technical restrictions can make the identification of the calls impossible.

Moreover identification is impossible if the calls are made from a public telephone booth or from another country. The identity of the perpetrator of calls/SMS’s originating from a mobile phone using a prepaid phone card is not always known. Attempted calls are not systematically registered.

5) At the end of this procedure the complainant still has the possibility of taking legal action.

6) If, during this procedure, the Ombudsman establishes that criminal acts have taken place, in accordance with Article 29 of the Code of Criminal Procedure he is obliged to immediately inform the Public Prosecutor.
